Please do.  We are waiting to see what you find out and then we will try.  I have talked to fair finance and they will not send me a paper statement.
So, your bank draft is still with Fair Finance?  How could they not supply you with YOUR information?  I would draft a letter or email them cancelling your membership and list the reasons (co-ed gym for one).  At least you will have the "ball" rolling.

My wife just hung up with one of the other Lifestyle gyms and they told her what to do.

She is mapquesting our address with closest Lifestyles, which I believe is Franklin Park area, if it is over 25 miles they will terminate her contract for her.

She has this info. at home so I will check it out for you.

OK thanks!  I did email Lifestyles to cancel with no response-but that's ok for now-waiting to see what the bank draft company does.

Here's the latest:  I received this email from Lifestyles:

Thank you for your email.  While we realize that the consolidation into the Monroe Family YMCA seems like an inconvenience at first thought we would like to take a moment to point out some of the positive aspects of this transition.  The YMCA does offer a women's only area in the locker room, private lockers, showers and saunas, a pool, a gymnasium, aerobics and a supervised kid's klub.  The staff at the YMCA is friendly and willing to help you familiarize yourself with their equipment.  You can visit the YMCA to get an updated copy of the new aerobics schedule, which most classes are included in the price of your membership.

 

We are writing to confirm we have received your request for cancellation of your membership agreement.  We are not able to grant your request, at this time.  The following is the contractual obligation by the member in the case of seller's transfer of membership as stated on the back of the membership agreement: 

 

TRANSFER OF MEMBERSHIP: Unless prohibited by law, in the event Seller ceases operations at the Fitness Center location identified on the front of the Contract, Seller reserves the right to transfer Buyer's membership privileges to another facility located within a reasonable distance of the closed facility or within such distance as otherwise provided by law.

 

We do apologize for any frustration or confusion you've encountered.  We are legally responsible for the following terms and conditions outlined in the agreement.  The above terms are outlined in the legal binding membership agreement you signed.  We appreciate and thank you for your cooperation and understanding of the membership agreement. 

 

A copy of your contract is available upon written request to Lifestyles for Ladies Only PO Box 677 Lambertville, MI 48144.

 

If you need further assistance familiarizing yourself with the YMCA or for any further questions, please call them at 734-241-2606.

My response:  Again I told them I want to cancel my membership.  I again gave them the reasons why.  I told them if they did not cancel it I would seek further recourse.  I have not heard back from the bank draft company - I will call them this afternoon.  Keep you posted!
I called ASF (1-800-525-8967) they said my letter was forwarded to the cancellation dept and if there were any problems they will contact me within 10 business days.  So we will see what happens!.  You can go on their website www.myasfaccount.com/cancel/cancelcontract.asp and read the "Request to Cancel Retail Sales Contract".  Take notice to "A comparable facility is not provided."  The notice also states "The facility has no authority to cancel your contract...in any way whatsoever" (The facility assigns all rights to them)

CIA:  I have spoke to a MT friend that has told me we could very easily put together a class action lawsuit to recoup some of our membership costs.  We probably have quite a few Temperance/Monroe gals that would sign an affidavit to get this started.  If this is already being headed up I would like to know how to get in and if not does anybody on here have half an interest, or are you satisfied with what LFL has done?

By the way the Y hottub for the gals is still gross.

How can a hot tub that's been down for 3 weeks be gross?? They are re-doing it as we speak. I'm so sick of people trashing the Y there's nothing wrong with it OR it's hot tub!

The bank draft company will let me know w/in 10 days regarding the status of my cancellation.  If they will not honor my request I would persue other actions.  I do believe the class action lawsuit would be the way to go!  Any MT's out there have access to free legal advice?

My wife ran a letter down to Lifestyles last week and she is awaiting a reply.  They had told her to print a map showing she lived 25 miles or more from the nearest Lifestyles and they would stop the contract.

We will see and I may take you up on your offer.

I have been trying to gt my membership cancelled since January. ASF has rejected my request to cancel. I would love your help to get my contract cancelled. I am getting so frustrated with them!

Detroitgirl, what are the circumstances? What did you put down for reason for cancelling?  Why did they reject you?

I believe that I put down that the Y was unable to meet my needs at their facility. I am not quite sure the rest of it...but that was basically it.
