Veteran Sheriff accused of trafficking pot

ST. LOUIS (AP) — Sheriff Raymond M. Martin has been the law for nearly 20 years in a struggling southern Illinois county. But federal prosecutors say he's been breaking it lately by peddling pounds of pot, some seized by his own department, often in uniform and from his patrol vehicle.

Authorities on Monday led away a handcuffed Martin, 46, from his small Shawneetown office after his arrest on federal drug trafficking charges accusing him of supplying a dealer he threatened to kill when that man said he wanted out. The Gallatin County sheriff also allegedly pledged to use his authority to shut down rival drug traffickers.

"It's almost beyond belief," said Doug Maier, the sheriff in neighboring White County. Maier called Martin "a pretty low-key guy."

He continued, "Obviously, there was a different side that I've never observed."

Martin was jailed pending a Wednesday detention hearing on three counts of marijuana distribution and two counts of carrying a firearm, his service weapon, while trafficking drugs. He could not be reached for comment Tuesday.

A woman who answered his home telephone refused to comment, and Martin's court-appointed public defender did not immediately return messages.

Martin's job status was unclear Tuesday. Calls to Gallatin County Chairman Randy Drone rang unanswered, while calls to the sheriff's department rolled over to a neighboring dispatch center, which regularly answers calls when no deputies are in Martin's office. No one would say the exact size of Martin's department, other than to say it's small.

Martin's popularity in the county surrounding Shawneetown — boasting little more than a courthouse, a couple of convenience stores and Rudy's barbecue restaurant — swept the Democrat to re-election four times since he took office in 1990.

A criminal complaint accuses him of distributing more than two pounds of marijuana between April 27 and May 11. But an affidavit by Glenn Rountree, an investigator with the Drug Enforcement Administration, suggests Martin's dealings were many times that total.

n a blow-by-blow account painting a picture of a good cop gone bad, Rountree wrote that Martin hatched a marijuana-dealing scheme in November with the drug dealer who later got cold feet.

At that time, Martin handed the dealer, unidentified in court papers, two pounds of pot and asked if the man could "get rid of that" for the sheriff, who promised he'd use his power to protect him if he ever got caught selling. If the dealer didn't comply, Rountree wrote, Martin said he could "make up" a crime against him.

From then until early last month, Martin brought 1- or 2-pound amounts of marijuana on average once every couple of weeks to a rural, secluded meeting spot, Rountree wrote. But the sheriff twice brought 10 pounds and brought 20 pounds another time, according to the affidavit.

The meetings between the two were arranged by cell phone, with the dealer using vague code words Martin supplied to confuse possible eavesdroppers, including investigators, Rountree wrote.

The dealer grew unsettled over time and wanted out, but Martin would have none of that, Rountree wrote. At least twice, the sheriff pulled his service revolver and insisted emphatically to the dealer that making him "disappear" would be "that easy," according to the affidavit.

Rountree suggested the twitchy dealer went to investigators April 9. Over the next several weeks, authorities taped the dealer's conversations with Martin and tracked the sheriff's county-issued Ford Expedition.

At least once, Rountree alleged, the sheriff gave the informant marijuana seeds, saying he could pare his debt to the sheriff by growing pot plants for him.

And the sheriff dispensed advice, cautioning the man that it'd be "silly" for the dealer to get drunk or use pills and "mess it up" because "we got a good thing going."

"(You) won't even have to work and stuff," Rountree said Martin once told the snitch.

Such profit could be particularly attractive in Gallatin County, where the population has slowly eroded in recent decades as many of the region's coal mines closed. Its 9 percent unemployment rate is typical in the region. The median household income, according to 2000 Census Bureau figures, is $26,118.

Martin's county salary was not immediately available, but he received his $6,500 annual stipend from the state this month.

The area received statewide attention in 2005, when a story by the (Arlington Heights) Daily Herald noted that the tiny county with little violent crime was getting more homeland security funding per person — more than $300,000 — than any other in Illinois.

The article noted Martin spent "most days battling a thriving methamphetamine trade."

Allegations that Martin himself was dabbling in drugs left locals rattled, in many cases leaving them publicly reticent Tuesday. Still, many there remained in Martin's camp.

"I thought the world of that boy," said Roberta Tarrence, a 78-year-old widow with a quilting business near the county courthouse. "I've known him all of his life, and I know he was a good sheriff."

Detroit atty, ex-cops among 74 indicted in probe

An adviser to the mayor and two former police officers were among dozens of members and associates of a motorcycle gang charged Thursday with attempted murder, cocaine and steroid distribution and other crimes.

Attorney Hatim "Tim" Attalla, a member of newly elected Mayor Dave Bing's volunteer crisis team, was named in a 35-count indictment unsealed in U.S. District Court in Detroit. Federal prosecutors said he acted "as general counsel" for the gang, the Highwaymen, and accused him of conspiracy to possess with intent to distribute, and distribution of, controlled substances.

Authorities said 30 defendants were in custody Thursday, and others were being sought. Some suspects told law enforcement officials that they would turn themselves in. It was not immediately known whether Attalla was arrested.

Bing said in a statement released Thursday night that he was "surprised and disappointed" to learn of Attalla's indictment. He said Attalla was being vetted and put through orientation but will resign immediately.

Phone and e-mail messages for Attalla left after-hours Thursday were not immediately returned.

The indictment caps a long-running investigation of the Highwaymen by the FBI, the U.S. attorney's office and state and local law enforcement agencies. Of the 74 people charged, 16 men were accused of being leaders of the gang and of directing others to carry out crimes. Some defendants were accused of conspiring to kill members of another motorcycle club and others were charged with transporting stolen motorcycles into Michigan.

If convicted, the defendants could face prison sentences that include up to 40 years for cocaine distribution.

In addition to Attalla, two former police officers from Garden City and Hamtramck and group president Joseph "Little Joe" Whiting were among those named in the indictment. Assistant U.S. Attorney Diane Marion said Whiting was expected to be arraigned Friday and would seek a court-appointed attorney.

William Swor, an attorney for ex-Garden City police sergeant David "Stifler" Tomlan, said his client liked to ride motorcycles and had "done nothing wrong." Richard Convertino, attorney for former Hamtramck police officer Randell Hutchinson, said his client was not a member or an associate of the Highwaymen.

The investigation, which spanned many years, was "the largest prosecution in the history of Michigan" and one of the largest of its kind in the country, U.S. Attorney Terrence Berg said Thursday.

The Highwaymen is a national organization based in Detroit, Berg said. An e-mail message seeking comment from the club was not immediately returned Thursday.

Four cops lied on search warrants, swearing under oath that drugs had been tested by the police department's crime lab when they had not. The bogus warrants have resulted in the dismissal of at least sixteen criminal cases. The cops also are believed to have lied to the department's internal affairs division. An attorney for the cops says they got no training. But how much training do you need to tell the truth?

Officers Fired After Beating an Unconscious Suspect Caught on Tape


BIRMINGHAM, Ala. —  Five Birmingham police officers were fired Wednesday for beating an unconscious suspect ejected from a car after a chase, an attack captured on a patrol car videotape that didn't surface publicly for a year.

Police Chief A.C. Roper said the officers, who were not identified, were seasoned veterans but acted in a "shameful" manner.

The video shows police pursuing Anthony Warren's van on Jan. 23, 2008. One officer on foot was hurt when the van swerved through traffic. It overturned on a ramp, ejecting Warren, who lay motionless as officers ran toward him. The video shows them beating him with their fists, feet and a billy club.

An attorney representing Warren in a civil case said he was hospitalized after the chase and didn't realize he'd been beaten until a prosecutor preparing for his trial requested the tape, saw the attack and told the defense about it.

Roper said the department had "terminated 50 years of combined service due to 10 seconds of injustice."

The officers can appeal.

Wendy Crew, an attorney for Warren, filed a claim against the city in March, the first step before filing a lawsuit seeking damages. She said Wednesday the claim was over the "horrific" beating and an attempt to suppress the video of it.

Authorities believe numerous Birmingham officers and as many as a half-dozen supervisors saw the video over the past year, but none reported it.

"In addition to these terminations, we're also reviewing our supervisor's actions, reporting mechanisms and policies," Roper said.

He said supervisors may face discipline, and the Alabama Bureau of Investigation will review possible criminal charges.

District Attorney Brandon Falls said Wednesday the tape of the beating surfaced unexpectedly as prosecutors were preparing to try Warren.

He said prosecutors had a video of the chase "but the beating was not on the copy we had."

Falls said the prosecutor wanted to play the video for the jury but, for technical reasons, she needed another copy and asked for the original.

"We got the original the week before the trial ... and that's where she saw the rest of the tape," he said.

He said they contacted the defense, the Alabama Bureau of Investigation and the Birmingham police chief.

Warren, who was held on $1 million bond after the chase, pleaded guilty in March 2009 to first-degree assault and was sentenced to 20 years in prison. Because of his plea, no trial was held, and Crew said Warren knew about the tape when he pleaded guilty.

Crew said police "deliberately tampered with the evidence" in their handling of the video prior to the criminal trial.

"As horrific as the beating is, the deliberate tampering of evidence is just as horrific," she said.

Crew, who did not represent Warren in the criminal case, said he fled in the van because he was confronted by a man who never identified himself as an officer, was not in uniform and drove after him in an unmarked car. She said he had not been accused of any crime when the pursuit began.

She said Warren, who was hospitalized for a few days after the chase, was "totally unconscious" when he was beaten and did not know it happened until the video surfaced.

UPDATE:

The mother of a 14-year-old boy said her son was beaten so badly by police officers earlier this month that she didn't recognize him when she went to find him at the hospital.
Karen Casey told CNN's Headline News that her son, Trevor, and his friends were sitting on the steps of a home in Toledo, Ohio, when police told them to move. Trevor, according to Casey, was slow to get up and police grabbed him and slammed his face on a squad car.

Trevor said the hood of the vehicle was too hot and he tried to get up, at which point police choked him, his mother told CNN.
Police said the boy refused orders to leave a home where he was loitering and resisted arrest repeatedly.
The incident was caught on video and it shows Trevor restrained in a chokehold by a police officer. His face is bloody and he appears to be unconscious before he falls to the ground.
"He thought he was going to die," Casey said. "He felt like they were crushing the lights out of him."
A statement from a police report said Trevor refused to put his hands behind his back when told to do so by the arresting officers. Police said he told them he had been smoking marijuana before the confrontation began.
"His mother came in ... and filed a formal complaint with internal affairs, and the matter will be thoroughly investigated," Toledo Police Chief Mike Navarro said in a statement.

Boo Hoo!   :'(

In the Toledo video, CNN reports it being in Albuquerque... Reporting incorrect information just proves networks have no genuine concern for the community or the victims family... Ratings come first, followed by advertisers who pay big bucks...  And raw suspected brutality footage draws in an enormous audience.

I too believe the force was tad excessive.  Again, these Officers actions don't account for  all 800,000.. not even half.

OBEY or face the consequences.  It's all about the socialist movement on in this country.  Who do you think trains the cops and why do you think they act so military like nowdays.

Law enforcement personnell consider themselves 'above the law'.  Not all, but a large portion do.

Come on people, wake up.....Forget that.  Just keep snoozing as your civil rights slip away.  You don't really care, the government will wipe your posterior no matter what......yeah, right. 8*

I think you have to take a deep look at yourself when considering law enforcement as a career.  I considered it when I left the military and the more I thought about how I would react in different situations the more I questioned my ability to handle the job.  Adults hurting kids, Men beating their wives and just the temptation of mouthy assailants challenging you.  I to this day don't think I could just simply put the cuffs on a man after beating or abusing a child.  Not defending the actions of abusive or crooked cops just identifying that it takes a strong individual to be a good cop.

I remember reading a thought-provoking essay by Dick Gregory several years ago in which he promoted the idea that the two highest paid professions should be teacher and police officer.  He provided compelling arguments that very few people have more influence on society and that both of these professions should be composed only of intelligent, highly-trained individuals.  While we see a few dedicated, quality people in these jobs, unfortunately the best and brightest are not attracted because the pay is mediocre at best.

I see that the alabama officers fired story left off the part where the suspect/victim of the beating struck or attempted to strike an officer with a vehicle knocking this officer to the ground moments before the crash and the beating......  I am sure those officers were upset and reacted no differently than most of you would.... then again, there are some forum users with not much better to do than start these cop hater threads, and give everyone with a beef toward cops to say most if not all cops are crooked,abuse their powers, the crap goes on and on.... I am sure if someone tried to run a loved one of yours or you friend over with car that given the chance many of you would have done the same thing... I have seen the whole video not just the short clip here in this thread

And I agree with jay doodle that the Toledo incident is being blown way out of proportion because the whole incident is not on any video I have seen.  Now if I saw a video where they really were striking him and gave him the injuries to the face then I would be able to say that the abuse allegation was correct.
