A Texas father accused of killing a ranch hand he allegedly caught sexually assaulting his young daughter will not be facing homicide charges.

In fact, a grand jury on Tuesday chose not to indict the unidentified 23-year-old in a Lavaca County case that garnered nationwide attention.

It happened on June 9 at the family ranch off County Road 328, between Yoakum and Shiner, where the father fatally beat 47-year-old Jesus Flores and then called 911 to report the incident.

According to County District Attorney Heather McMinn, jurors did not indict the father on homicide charges because there was overwhelming evidence that his actions were justified.

"Under the law in the State of Texas, deadly force is authorized and justified in order to stop an aggravated sexual assault or a sexual assault," McMinn said. "The 5-year-old victim had sustained some physical injuries that were noted by a nurse and were consistent with all of the witness statements."

Still, defense attorney D'Anne Huser said her client never intended to end a life.

"He is a peaceable soul and he had no intention to kill anybody on that day, but he has to live with that," Huser said.

Word of the father's exoneration spread quickly throughout county, with friends and supporters expressing relief.

But the father and his family did not want to be interviewed.

I'm relieved.  This father and his family have been through so much trauma, and waiting for the Grand Jury's determination must have felt very long.   I hope the father and the daughter have all the support they will need.

What a terrible situation on all sides, a hurt child, and a father needing to defend her against a rapist. I can't think of a more challenging, sad set of circumstances. Glad he can go home, and possibly rest easy with his family.

Difference of Texas over many other states...  especially in light of all the media frenzy against our rights to defend ourselves and our families.

I would have voted with the Jurors on this one. 



It also makes me wonder if Jerry Sandusky realizes how lucky he is that he does not live in Texas.

I agree.

One of the particulars of the case is that he caught the guy in the act. If he had found out about it later and then went and killed the guy, things might be different.

Not that they should be.

It's a horrible thing, to take a life.

But in some ways, the rape of an innocent child is far worse.

I agree that the killing was 100% justified. 

I hope the child and her family gets all they help they need.
